Welcome to Aestie. These Terms of Use (“Terms”) govern your use of the Aestie platform, including our website, mobile applications, and related services (collectively, the “Platform”). By creating an account or using the Platform, you agree to these Terms. If you do not agree, please do not use Aestie.
1. Who We Are
Aestie is an online platform that enables users to research, document, and share experiences related to cosmetic and aesthetic treatments. Aestie does not provide medical advice, practice medicine, or guarantee or endorse any provider or treatment. All content on Aestie is provided for informational purposes only.
2. Eligibility
You must be at least 18 years old to use Aestie. By using the Platform, you represent that you are 18 or older and have the legal capacity to enter into these Terms. Aestie is currently available to users in the United States. By using the Platform, you represent and warrant that you are not prohibited from using the Platform under any applicable law.
3. Compliance with Local Laws
You are responsible for ensuring that your use of the Platform complies with all applicable laws and regulations in your jurisdiction. Aestie makes no representation that the Platform is appropriate or available for use in every location.
4. Your Account
Registration
To access most features, you must create an account. You agree to provide accurate, current, and complete information and to keep it updated. Aestie does not require your real name to register — accounts are pseudonymous by design.
Account Security
You are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account. Notify us immediately at support@aestie.co if you believe your account has been compromised.
One Account Per Person
You may not create more than one account, use another person's account, or create an account on behalf of someone else without their consent.
5. Platform Access and Founding Membership
Aestie may offer different levels of access, including Founding Member access and other access programs introduced from time to time. Eligibility may depend on factors such as contribution, verification, location, treatment type, participation, referral status, or payment.Founding Member access may include benefits, features, or privileges described at the time of enrollment. Aestie may modify, suspend, or discontinue access levels, eligibility requirements, or features at any time, subject to applicable law and any specific commitments made to participants.
Contribution-Based Access
Aestie may allow users to unlock additional reviews, journeys, features, or other Platform content by submitting an eligible contribution. The applicable eligibility requirements, review process, and access provided will be described at the time of participation.Submitting a contribution does not guarantee acceptance or access. Aestie may reject or withhold access for contributions that are incomplete, duplicative, fraudulent, unverifiable, misleading, or inconsistent with these Terms or other Aestie policies.
6. User Content
Your Contributions
You may submit reviews, before/after photos, procedure details, provider attributions, recovery timelines, ratings, comments, and other content (“User Content”). You are solely responsible for the accuracy, legality, and appropriateness of your User Content.Aestie may, but is not obligated to, update, remove, restrict, anonymize, or retain User Content when reasonably appropriate to correct errors, comply with legal obligations, enforce these Terms, address privacy or safety concerns, protect the rights of others, or maintain the integrity of the Platform.
Public Contributions
User Content you submit for publication, including reviews, journey details, ratings, provider information, pricing, recovery updates, and photos you choose to share, may be publicly displayed on the Platform. Although Aestie supports pseudonymous profiles, your content or photos may still make you identifiable.
License to Aestie
By submitting User Content, you grant Aestie a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, distribute, adapt, and otherwise use your User Content as reasonably necessary to operate, improve, and secure the Platform, and to promote the Platform where you have authorized that use or as otherwise permitted by applicable law. This license includes the right to create anonymized or aggregated data derived from User Content, subject to Aestie's Privacy Policy. You retain ownership of your User Content.
Content Updates and Retention
User Content may not currently be directly edited or removed through the Platform after submission. Aestie may update, remove, restrict, anonymize, or retain User Content as appropriate, including in response to correction requests, privacy or safety concerns, legal obligations, or violations of these Terms.If you delete your account, certain account information may be deleted or de-identified. User Content may remain publicly available or be retained in anonymized form, subject to applicable law and Aestie's Privacy Policy.
Accuracy and Authenticity
You represent that:
- Your contributions reflect your genuine, firsthand experience.
- Before/after photos and supporting materials are authentic and unaltered beyond standard editing.
- Any verification materials you submit (receipts, appointment confirmations) are real and belong to you.
- You have clearly disclosed any compensation, free or discounted treatment, provider relationship, employment, family relationship, referral benefit, or other material connection related to your treatment or User Content.
Aestie does not independently verify every submission but reserves the right to remove content that appears fraudulent, misleading, or in violation of these Terms.
Content You Do Not Own
Do not submit content that includes photos, text, or materials you do not have the right to share. Do not submit identifiable images of other people without their permission. Posting identifiable photos of others without their permission may result in content removal, account suspension, or termination.
7. Prohibited Conduct
You agree not to:
- Post false, misleading, or fabricated reviews or journey content.
- Submit content on behalf of a provider, brand, or third party without clear disclosure.
- Harass, threaten, or abuse other users or providers.
- Use the Platform to solicit clients, promote services, or conduct commercial activity without authorization.
- Attempt to manipulate provider rankings, ratings, or visibility.
- Circumvent or tamper with access controls, contribution requirements, verification systems, or payment systems.
- Scrape, crawl, or extract Platform data through automated means without our written permission.
- Create fake accounts or misrepresent your identity.
- Use the Platform in any way that violates applicable law.
Violations may result in content removal, account suspension, or permanent termination.
8. Provider Content and Profiles
Provider profiles on Aestie are populated in part by user-submitted content and are not controlled by providers. Providers cannot pay to alter, suppress, or remove authentic user reviews. Aestie may remove, restrict, or modify content when required by law or when content violates these Terms or other Aestie policies. Provider presence on Aestie does not constitute an endorsement by Aestie. Users are responsible for conducting their own due diligence before selecting any provider.Providers and other affected parties may report content they believe is factually inaccurate, unlawful, fraudulent, or violates these Terms by contacting support@aestie.co. Aestie may request supporting information and may correct, restrict, annotate, or remove content where reasonably appropriate. Aestie will not remove or alter authentic content solely because it is negative, disputed, or unfavorable to a provider.
9. Subscriptions and Payments
Paid Tiers
Certain features require a paid subscription. Subscription fees, billing cycles, and plan details are described at the point of purchase and may be updated from time to time.
Billing
By subscribing, you authorize Aestie to charge your payment method on a recurring basis at the applicable rate. All fees are in USD.
Cancellation and Refunds
You may cancel your subscription at any time through your account settings or by contacting support@aestie.co. Cancellation takes effect at the end of the current billing period unless otherwise stated or required by law. Fees are non-refundable except where required by law or expressly stated at the time of purchase.
Price Changes
We will provide reasonable advance notice of any price changes. Continued use of a paid subscription after a price change constitutes acceptance of the new rate.
10. Not Medical Advice
Aestie is not a medical platform. Content on Aestie — including reviews, before/after photos, recovery timelines, and provider profiles — is user-generated and for informational purposes only. Nothing on the Platform constitutes medical advice, diagnosis, or treatment. Always consult a qualified, licensed medical professional before making any decision about a cosmetic or medical aesthetic procedure. Aestie is not responsible for any decisions made based on content found on the Platform.
11. Intellectual Property
All Platform design, software, branding, and non-user-generated content is owned by Aestie and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from Aestie's proprietary content without express written permission.
12. Copyright Complaints
Aestie respects intellectual property rights. If you believe content on the Platform infringes your copyright, please send a written notice to Aestie's designated copyright agent at legal@aestie.co that includes:
- Identification of the copyrighted work.
- Identification and location of the allegedly infringing content.
- Your contact information.
- A statement that you have a good-faith belief that the use is unauthorized.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act for the copyright owner.
- Your physical or electronic signature.
Aestie may remove or restrict allegedly infringing content and may terminate accounts of repeat infringers where appropriate. Users may submit a valid counter-notification where content was removed because of mistake or misidentification.
13. Third-Party Services
The Platform may contain links to or integrations with third-party websites, tools, or services. Aestie does not control and is not responsible for third-party content, privacy practices, or terms. Your use of third-party services is at your own risk.
14. Termination
By You
You may request deletion of your account through your account settings, where available, or by contacting privacy@aestie.co. Account deletion and the treatment of User Content are subject to these Terms and the Privacy Policy.
By Aestie
We may suspend or terminate your account at any time if we believe you have violated these Terms, engaged in fraudulent activity, or pose a risk to the Platform or other users. Where possible, we will give you notice and an opportunity to address the issue before terminating.
Effect of Termination
Upon termination, your right to access the Platform ends. Aestie may delete or de-identify certain account information, while retaining information necessary for legal compliance, fraud prevention, dispute resolution, security, or other legitimate business purposes. User Content may remain publicly available, be anonymized, restricted, or removed in accordance with these Terms and the Privacy Policy.Provisions that by their nature should continue after termination will remain in effect, including provisions concerning User Content licenses, intellectual property, payments, disclaimers, limitation of liability, indemnification, dispute resolution, and any rights or obligations that arose before termination.
15. Disclaimers
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” AESTIE MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE PLATFORM'S RELIABILITY, ACCURACY, AVAILABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE OR UNINTERRUPTED.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AESTIE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO DECISIONS MADE BASED ON PLATFORM CONTENT. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO AESTIE IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) $100.
17. Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless Aestie and its affiliates, officers, directors, employees, and agents from third-party claims, liabilities, damages, and reasonable expenses, including attorneys' fees, arising from your User Content, your violation of these Terms or applicable law, or your infringement of another person's rights.Nothing in these Terms limits or excludes any rights, remedies, warranties, or liabilities that cannot be limited or excluded under applicable law.
18. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles.Before filing a legal claim, you and Aestie agree to make a good-faith effort to resolve the dispute informally. To begin this process, send a written notice describing the dispute and requested resolution to legal@aestie.co. If the dispute is not resolved within 30 days after the notice is received, either party may pursue any remedy available under applicable law.Any legal action arising out of or relating to these Terms or the Platform must be brought in a court with lawful jurisdiction over the dispute. Nothing in this section prevents either party from bringing an eligible claim in small claims court or seeking emergency injunctive relief.
19. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the Platform, by email, or by another reasonable method before the changes take effect. Your continued use of the Platform after the effective date of the updated Terms constitutes acceptance of the changes.
